Çalışmada Libya'nın Mâlikî mezhebine müntesip iki aliminin fetvalarında zikredilen hadis rivayetlerinin tahrici ve tahkiki yapılacaktır. Bu iki âlimden ilki Muhammed Kirriv diğeri ise Miftâh el-Lebîdî'dir. Her iki âlim de Libya'nın en önemli şehirlerinden biri olan, başkent Trablus'un 200 km. doğusunda Akdeniz kıyısında yer alan Misrata şehrinde doğmuş ve orada vefat etmiştir. Kirriv ve Lebîdî hicri XIV yüzyılın ikinci yarısı ve XV yüzyılın ilk çeyreğinde yaşamıştır. Her iki âlim de tedris, vaaz ve fetva ile uğraşarak ilim ile dolu bir hayat yaşamış bunun yanında insanlar arasındaki huzursuzluklardan kaynaklanan problemlerde arabuluculuk yapmışlardır. Dolayısıyla onların hem ilim alanında mümtaz bir konuma hem de insanlar nezdinde müstesna bir yere sahip olduklarını söylemek mümkündür. Kirriv ve Lebîdî, Libya'nın farklı pek çok ilim alanında mahir olan kadim âlimlerine örnek teşkil etmekte olup; tefsir, hadis, fıkıh, usûl, farklı alanları ile dil, mantık felsefe ve kelam ilimlerinde söz sahibidirler. Çalışmanın ana konusuna girmeden önce İslam'ın Libya topraklarına girmesinden bu iki âlimin yaşadığı çağa kadar Libya'da ilmi hayatın nasıl doğduğu ve geliştiğine dair bir giriş yapmak gerekmektedir. Böylelikle Libya'nın henüz çok erkek sayılabilecek bir dönemden itibaren İslamî ilimlerle olan bağı açığa çıkacak; hem de sahabe döneminden itibaren süregelen ilmi gelenek bu şekilde ortaya konulacaktır. Çalışmamız iki açıdan önemlidir. Birinci nedeni, çalışmada, âlimlerimizin hadis ve hadis ilimleri ile var olan sıkı bağı ortaya konulmuş olup, bu sayede onların, kendilerinden önce yaşamış âlimleri taklit etmekle yetinmediği, kitaplarında sadece fıkıh metin ve haşiyeleri ile uğraşmadıkları ve daha önemlisi sünnet ile aralarında bir mesafenin olmadığının tespit edilmesidir. İkincisi: Libya'nın yetiştirmiş olduğu iki güzide âlimin, kendi dönemlerinde insanların ihtiyaçlarına cevap veren fetvaları derlenip hadis ilim açısından tahlile tabi tutulmasıdır. Çalışmamızda, öncelikle genel hatlarıyla tarihi çerçevede Libya'ya İslam'ın girişi ve dolayısıyla Hadis ilminin takibi ile oluşan ilmî hayatın ilk temelleri ve öncü isimleri olan sahabe ve sonraki âlimler tespit edildi. Daha sonra özellikle tarih boyunca bu iki alime kadar bu topraklarda yetişen ilim adamlarından genel olarak bahsedildi ve tezimize konu olan iki âlimin; biyografisi ve ilmi hayatı izah edildi. Sonraki bölümde fetvalar ele alındı ve bu fetvalar hadis ilmi açısından çeşitli yönleriyle tahlile tabi tutuldu. Bu bağlamda hadis rivayetlerinin sahihlik ve zayıflık açısından dereceleri tespit edildi ve âlimlerin bu husustaki görüşlerine yer verildi. Böylelikle özellikle ilim dünyasına bu iki büyük âlimin hadis alanındaki hizmetlerini tanıtmış olduk. The main theme of this study is to investigate and dissent of sayings collected from fatwas of great scholars of Maliki School in Libya, namely: Sheikh, Mohammed kerrio and Sheikh, Meftah Al-Libidi, who were born and lived in the city of Misrata, the third most important Libyan city, during the last half of the fourteenth and the first quarter of the fifteenth Hejra century, corresponding to most of the twentieth AC Both Sheikhs had a large and prominent role in the scientific life, the fatwa and reform among people, coupled with a solemn place of love, appreciation and awesome in the hearts of the people. Both are a model and example of the Libyan veteran scholars, who were mastering all arts and branches of sciences; the interpretation, Hadiths, jurisprudence and its principles and branches Arabic language of its branches, logic, philosophy, speech…etc. This research is divided into two main sections: The first is the study and the second is the investigation. The study section concludes: introduction about Libya, and its history throughout the most important stages and eras that Libya witnessed. A brief about the scientific life in Libya, and the Hadith science in Libya since the Islamic conquest to the sheikhs time, Kerrio and Al-Libidi, then the time of the two sheikhs and the most important circumstances and events, their biographies and scientific impact. In order to be present the research is a complete historical context showing its usefulness and the early relevant of this country to Islam and the Islamic sciences. As well as the continuation of close correlation and scientific back up to scholars of our country since the time of the companions, Allah bless them their followers, and their students who followed them up to date. The importance of this work, in my opinion, it comes in two points: to proof a close connection of our scholars of the Sunnah and its sciences; in the framework of the school of Maliki jurisprudence, not as thought and described by some people as mere scholars of texts, footnotes, and imitators of their mentors, not related to the Hadiths and Sunnah. To collect and document the fatwas of two Libyan major scholars who had a prominent scientific activity for more than half a century, one of its achievements is these important fatwas that solved many issues in the people's lives at those times with a scientific and historical values added to the treasures of our Islamic civilization. Next to the study, an investigation of a group of these fatwas, referring the texts to their sources and dissenting of the Hadiths, explanation of their grade and judgment and the opinions of the scholars, till achieving compete targeted benefits, to preserve the legacy of these two honourable scholars and to acquaint researchers of its intended image.
