dc.description	Tezimizin konusunu "Elektronik Konişmento ve Rotterdam Kuralları'nda İlgili Düzenlemeler" oluşturmaktadır. Elektronik konişmento, henüz tam olarak kabul görmüş bir düzenleme olmamakla birlikte, yeni gelişmelere ayak uydurma zorunluluğundan ötürü, kabul görmesi beklenilmektedir. Elektronik işlem ve belgelerin ayrıntılı olarak düzenlenmiş olduğu, deniz yolu taşımasını ilgilendiren tek düzenleme de Rotterdam Kuralları olarak göze çarpmaktadır. Her ne kadar Rotterdam Kuralları'nın yürürlüğe girmesi zaman alabilecekse de bazı düzenlemelerinin uygulamada yer bulabileceği düşünülmektedir. İşte bu düzenlemelerin en önemlilerinden biri Rotterdam Kuralları'nın elektronik belgeler ile ilgili olan kısımlarıdır. Tezimiz dört ana başlıktan oluşmaktadır. İlk başlık altında geleneksel konişmento üzerinde durulacak ve konişmentonun tanımı, çeşitleri, içeriği ve işlevleri gibi konulardan bahsedilecektir. İkinci kısımda elektronik ticaret ve elektronik belgeler, bunlarla bağlantılı olarak kullanılmakta olan EDI uygulaması incelenip, elektronik işlemler ile ilgili hukuki düzenlemeler ele alınacaktır. Üçüncü kısımda ise elektronik konişmento kavramı, konişmentonun elektronikleşmesi, taşıması gereken unsurlar, senet ve kıymetli evrak olarak elektronik konişmento ve uygulamadan SEADOCS, CMI, BOLERO, @GlobalTrade, TradeCard, ESS-DatabridgeTM, Korea Trade Net (KTNET) gibi örneklerden ve Blockchain teknolojisinden bahsedilip, elektronik konişmentonun geleneksel konişmentonun işlevlerini tam olarak yerine getirip getiremeyeceği incelenecektir. Son kısımda ise Rotterdam Kuralları'ndaki ilgili hükümlere değinilecek ve elektronik konişmento açısından değerlendirmesi yapılacaktır. dc.description	The subject of our thesis consists electronic bill of lading and related regulations in Rotterdam Rules. The electronic bill of lading is not a fully accepted regulation yet, but it is expected to be accepted because of the obligation to keep pace with new developments. Detailed editing of electronic transactions and documents and the only regulation concerning maritime transportation are drew the attention as Rotterdam Rules. Although it may take some time for the Rotterdam Rules to come into force, it is thought that some regulations may take place in practice. One of the most important of these regulations is the part of the Convention relating to electronic documents. Our thesis consists of four main chapters. Under the first chapter, the traditional bill of lading will be emphasized and the subjects such as the definition, types, contents and functions of the conveyance will be mentioned. In the second part, electronic commerce and electronic documents, EDI application which is used in connection with them will be examined and legal regulations related to electronic transactions will be discussed. In the third part, electronic concept of bill of lading, electronization of bill of lading, necessary elements to convey, electronic bill of lading as note and commercial paper, examples from practice such as SEADOCS, CMI, BOLERO, @GlobalTrade, TradeCard, ESS-DatabridgeTM, Korea Trade Net (KTNET) and Blockchain technology are mentioned, it will be examined whether the electronic bill of lading can fully fulfill the functions of the traditional convention. In the last part, the related provisions of the Rotterdam Rules will be referred and evaluation will be made in terms of electronic bill of lading.
