Haciz işlemi borçlunun normal yollar ile borcunu ödemediği durumlarda alacaklının alacak hakkını korumak üzere başvurduğu bir cebri icra yöntemidir. Bu yöntemde borçlunun mal ve haklarından paraya çevrilebilecek nitelikte olanlar arasından borcuna yetecek kadar olanı kamu gücü ile el konulmak suretiyle satılır ve satış hasılatı ile alacaklının alacağı ödenir. Bu çalışmada Türk hukuk sistemi ile Irak hukuk sisteminde cebri icra yoluyla haciz işlemine ait düzenlemeler incelenecektir. İki ülke sistemleri arasındaki benzerliklerin ve farklılıkların ortaya konulması bu çalışmanın temel amacıdır. Bu itibarla çalışmanın, yüksek ticaret hacmine sahip komşu iki ülke olan Türkiye ve Irak'ta karşılıklı faaliyet gösteren iş dünyasındaki tacirler ve yatırımcılara önemli bir katkı sağlayacağı düşünülmektedir. Çalışmada ülke hukuk sistemleri itibariyle haciz kavramının karşılaştırılması dört ana başlık çerçevesinde gerçekleştirilmektedir. Bu ana başlıklar; haciz kavramı ve genel bilgilendirme, üçüncü kişiler nezdinde bulunan alacakların haczedilmesi, mal ve hakların haczedilemezlik durumları ile bir alacaklının koydurmuş olduğu hacze başka alacaklıların katılabilme durumlarını ifade eden hacze iştirak başlıkları şeklindedir. Seizure process is a compulsory execution that the creditor applies for the protection of his own right of property in cases where the borrower is unable to pay the debt through normal means. In this method, the sufficient amount of property that is convertible to money of borrower to pay the debt is sold by seizure by public power. The debt is paid by the proceeds of sale. In this study, regulations of seizure through compulsory execution in Turkish and Iraqi legal systems will be examined. The main purpose of this study is to reveal the similarities and differences between the systems of the two countries. In this respect, the work is considered to make an important contribution to traders and investors in the business world that shows mutual activities in Turkey and Iraq where have high trade volume. The comparison of the concept of seizure by the legal systems of the countries in the study is carried out under the four main headings. These headings include the concept of seizure and general information, the seizure of receivables in the third person, the cases of non-seizability of goods and rights, and joining in a seizure.
