Çalışmamızda öncelikle doğrudanlık ilkesi hakkında genel bilgiler verildikten sonra bazı durumlarda usul ekonomisi ilkesi ile çatışan doğrudanlık ilkesinin istisnaları incelenmiştir. Çalışmamızın konusu olan doğrudanlık ilkesi usul kanunları düzenlenirken adil bir yargılamanın teminatını oluşturan başlıca ilkelerdendir. Bu bağlamda ülkemizde HMK düzenlenirken doğrudanlık ilkesi de dikkate alınarak doğrudanlığa uygun bir yargılama yapılması amaçlanmıştır. İncelememiz esnasında doğrudanlık ilkesinin genel amacı ve diğer bazı ülkelerdeki düzenlemeler göz önünde bulundurularak HMK’da yer alan ilgili hükümlerde genel olarak değerlendirilmiştir |
