Hukukumuzda genel iflâs sebebi, borçlunun vadesi gelmiş borçlarını ödeyememesidir. Borca batıklık, genel bir iflas sebebi değildir. Sermaye şirketlerinin (ve kooperatifler) iflâsı, bu kuralın dışında tutulmuştur. Borca batıklık, sermaye şirketleri (ve kooperatifler) için bir doğrudan doğruya, özel bir iflas sebebidir. Ancak, şirket tarafından mahkemeye verilecek ciddi ve inandırıcı bir iyileştirme projesi sayesinde, şirket hakkında iflasın ertelenmesi istenebilir. İflasın ertelenmesi, şirket hakkında iflas kararı verilmesini önleyen geçici hukuki bir kurumdur. Kurumun hukuksal boyutu yanında, ülke ekonomisini ilgilendiren yönü de bulunmaktadır. İflasın ertelenmesi kurumu ilk bakışta sadece şirket lehine bir kurum gibi gözükse de şirket alacaklılarının da lehinedir. Çünkü şirket iflas ederse alacaklılar alacaklarına tam olarak kavuşamazlar. İflasın ertelenmesi sayesinde eğer ki şirket mali durumu düzelirse, şirket ekonomik düzenden çekilmemiş olacak hem de alacaklılar haklarına tam olarak kavuşacaklardır |

In our law, the reason of general bankruptcy is that debtor can’t pay his debts which fall due. Be deeping in debt isn’t a general bankruptcy. The bankruptcy of capital companies (and cooperatives) are excepted from this rule. Be deeping in debt is a directly special reason of bankruptcy for capital companies (and for cooperatives). However; by means of the significant and persuasive project of improvement which will be given to court by company, the postponement of bankruptcy for company may be required. The postponement of bankruptcy is a temporary, legal institution preventing from making decision of company. In addition to legal aspect, institution has an aspect related to economy of country. Even if the institution of postponement of bankruptcy appears as an institution only in favour of company at the first glance, but it’s also in favour of creditors of company. Because, if the company goes bankrupt, creditors can’t accurately get their credits. If the company improves its financial situation by means of the postponement bankruptcy, it will haven’t been retreated from economic order; moreover creditors will accurately get their claims |
