Alenîyet ilkesi, yargılamanın tarafı olmayan üçüncü kişilerin, yargılamayı izleyebilmesi ve yargılamanın sonucunda verilen hükmü öğrenebilmesi anlamına gelir. Âdil yargılanma hakkının unsurlarından biri olan alenîyet ilkesi, yargılamaya egemen olan ilkelerdendir. Ancak, kişilik haklarının gelişmesi ve özel hayatın gizliliğinin korunması gereğinin kabulüyle birlikte, aleniyet ilkesi mutlak bir ilke olmaktan çıkmıştır. Ulusal ve uluslararası düzenlemelerde, gizli yargılama yapılmasına ilişkin farklı hükümler bulunmaktadır. Çalışmada bu hükümler irdelenerek, Türk hukuku bakımından somut çözüm önerileri sunulmaktadır. Özellikle, aile mahkemelerinde görülen dava ve işlerde yargılamanın gizliliği esasının benimsenmesi önerilmektedir |

Principle of publicity can be defined as the monitoring of a jurisdiction and learning the decision taken after jurisdiction by third parties who are not a party to that jurisdiction. Being one of the elements of fair trial, the principle of publicity is among the dominant principles in jurisdiction. However, due to the development of personality rights and the protection of privacy, the principle of publicity has ceased to be an absolute principle. In national and international regulations, there are different provisions present on the removal of the publicity of hearing. This study evaluates these provisions and offers some solutions for the Turkish law. Specifically, it is suggested that jurisdiction should be held absolutely closed in family court cases and works |
