Bu çalışmada, anayasal demokrasi içinde anayasa mahkemesinin konumu incelenmektedir. Bu bağlamda ilk olarak anayasal demokrasi ve anayasa yargısı arasındaki ilişkiye, anayasa yargısının önemine, anayasa yargısının meşruiyetine, anayasa mahkemesi ve siyaset ilişkisine değinilmektedir. Daha sonra anayasal demokrasi içinde Türk Anayasa Mahkemesinin konumuna ilişkin bazı tespitlerde bulunulmuştur. Makalede Türk Anayasa Mahkemesinin yarım asırlık geçmişi dikkate alındığında, hukuk devletinin yerleşmesinde ve iktidarların keyfi tutumunun önlenmesinde son derece önemli bir rol oynadığı, ancak Mahkemenin bazı durumlarda yetkilerini yanlış kullandığı, bazı konularda da anayasal yetkilerini açıkça aştığı, devletçi ve ideolojik bir yargısal aktivizm sergilediği sonucuna varılmıştır |

In this study, the position of constitutional court in a constitutional democracy is analyzed. Within this context, firstly the relationship between constitutional democracy and constitutional jurisdiction, the importance, the legitimacy of the constitutional jurisdiction, the relationship between constitutional court and politics are discussed. Then, some observations are made on the position of in a constitutional democracy. In the article, it is concluded that considering the half-century history of Constitutional Court of Turkey, the Court has taken an important role in the settlement of the rule of law and the prevention of arbitrary attitude of governments, however in some cases, the Court incorrectly used its powers, in some aspects clearly exceeds the constitutional powers and exhibited an ideological and statist judicial activism |
