Zâhiriyye mezhebinin kurucu imamı Dâvûd ez-Zâhirî’nin hüküm istinbat metodları kendi eserleri günümüze ulaşmadığı için tam olarak tespit edilememiştir. Bu çalışmada Dâvûd ez-Zâhirî’nin miras bıraktığı usûlünün tespitine yönelik küçük bir katkı sağlamak amacıyla onun delil ismini verdiği yöntemin içeriği belirlenmeye çalışılmıştır. Bu minvalde kanaatimiz Dâvûd ezZâhirî’nin usulüne has yönüyle delil, sırasıyla illet-i mansûsa, mefhûmu’lmuvâfaka, mefhûmu’l-muhâlefe adlarıyla anılan delâlet şekillerinin bir araya getirilmesinden ibarettir. Dâvûd ez-Zâhirî, mantûk ya da mefhûm yoluyla hükme ulaşamadığında ise Şâri‘in serbest bıraktığı durumları istishâbu’l-hâl prensibi gereği mübahlık kapsamında değerlendirmiştir |

They haven’t been exactly determined the ictihad methods of Dawud alZahirî who is the establisher of Zahiriyya because of the fact that his books couldn’t be able to reach today. In this article it is tried to be determined the method that Dawud al-Zahirî named evidence to contribute to definition of his methodology. Our opinion in this topic evidence from the point of Dawud alZahiri’s methodology is putting together indication shapes. These are in order: İllet-i mansûsa, mefhûmu'l-muvâfaka, mefhûmu'l-muhâlefe. When Dawud alZahirî couldn’t reach the judgment by means of explicit (mantûk) or implicit (mefhûm) meaning he evaluated the situations that Şâri released within permission by rule of the istishâbu'l-hâl principle |
