Konut yapı kooperatifleri ortaklarının belirli ekonomik menfaatlerini karşılıklı işbirliği, yardım ve dayanışma içerisinde sağlama ve konutu bulunmayan ortaklara konut yapma amacıyla kurulan bir kooperatif türüdür. Konut sahibi olmak genellikle orta ve dar gelirli kişilerin bireysel olarak güçlerini aştığı için konut yapı kooperatifleri temelde kişilerin konut ihtiyacını karşılamayı amaçlar. Amaçları kazanç elde etmek değildir. Amaçlarına ulaşabilmek için aidat miktarı belirleyerek ortaklarından aidat toplar. Ancak uygulamada konut yapı kooperatiflerinin ek mali kaynaklar oluşturmak, konutları daha hızlı şekilde tamamlamak gibi amaçlarla konutları kişilere sattıkları da görülmektedir. Bu ise, kooperatif konutlarının kişilere ortak kaydetmek suretiyle satılması şeklinde olabildiği gibi, ortak kaydetmeksizin satılması şeklinde de olabilmektedir. Söz konusu usullere uygulamada sıklıkla başvurulmasına rağmen, konuyla ilgili mevzuatımızda yeterli düzenlemenin olmadığı görülmektedir. Konut yapı kooperatifleri hakkında Kooperatifler Kanunu (Koop. K.) uygulanacaksa da, konut yapı kooperatiflerinde sabit fiyatlı satış sözleşmesi konusunda Türk Borçlar Kanunu (TBK) ve Türk Medeni Kanunu (TMK) hükümlerinden yararlanılması gerekmektedir. The Housing Construction Cooperatives refer to a type of cooperative which is established to provide the economic interest of the partners in mutual collaboration, assistance and solidarity, and to facilitate a residential building to the partners who don't own it. Due to the fact that owning a residential building exceeds the budgets of people individually, who have middle and small income, housing construction cooperatives basically aim at meeting the housing need of the individuals. Their purpose is not to derive profit. They collect contributions from the partners through designating a contribution amount for the purpose of reaching their goals. However, it can be seen that they sell the residential buildings to generate additional financial resources in practical, and to complete them more promptly. This can be in the form of selling cooperative housings to persons via registering them as partners, or by selling these housings without registering any partners. Even though the abovementioned procedures can be applied in operation frequently, the necessary regulations in our legislation relevant to the subject are limited. Whereas the Cooperatives Law (Coop. Law) will be implemented, the provisions set forth in the Turkish Code of Obligations (TBK) and Turkish Civil Code (TMK) are required to be practiced on the fixed-price sale contract regarding the housing construction cooperatives.
