Ticari işletmelerin finansal ihtiyacı, ticari işletmeler üzerinde rehin hakkı kurularak sağlanmaktadır. Piyasaların güncel ihtiyaçlarına uygun yanıtlar verilebilmesi, işletmelerin finansal ve rekabet güçlerinin arttırılabilmesi amacıyla kanun koyucu; 28/10/2016 tarihli Resmi Gazetede yayınlanan 01/01/2017 tarihinde yürürlüğe giren 6750 sayılı Ticari İşlemlerde Taşınır Rehni Kanunu ile Ticari İşletme Rehni Kanunu' ilga edilmiştir. Ticari İşlemlerde Taşınır Rehni Kanunu ile ticari işletme rehni, teslimsiz taşınır rehni olma özelliğini devam ettirmekle birlikte; rehnin kuruluşu, kapsamı, tescil edileceği sicil ile hüküm ve sonuçları bakımından birçok yeni düzenlemeye tabi olacaktır.Bu çalışmada ise, Ticari İşlemlerde Taşınır Rehni Kanunu'na göre kurulacak ticari işletme rehni konu edilmiştir. Financial need of commercial enterprises is supplied by a pledge over a commercial enterprise. The legislator, on the purpose of reply to the current needs of the markets and enhance the power of financial and competitive of enterprises, abolished the Pledge of Commercial Enterprises Act, with the Pledge of Movable Goods in Commercial Transaction Act, Act No: 6750, published in the Official Gazette dated 28/10/2016 and entered into force on 01/01/2017. Although the pledge of commercial enterprise in the Pledge of Movable Goods in Commercial Transaction Act maintains to be a non-delivery movable pledge; in terms of establishment, scope, registered, and provision and results of the pledge will be subject to many new regulations. In this study, commercial enterprise pledge to be established according to the Law on Movable Pledge in Commercial Transaction is discussed.
