Yerine getirdikleri kamu hizmeti dolayısıyla geniş anlamda kamu görevlisi statüsünde olan korucular, 442 sayılı Köy Kanunun vermiş olduğu yetki ve görevler kapsamında kırsal alanda devlet otoritesinin devam ettirilmesi ve vatandaşların can ve mal güvenliğinin temin edilebilmesi için terör örgütlerine karşı güvenlik güçleri ile birlikte görev yapmaktadırlar. Korucular, zor ve pekçok sosyal riski aynı anda barındıran görevleri uzun bir süre hiçbir sosyal güvenceleri olmadan yerine getirmişlerdir. Kamu düzenin sağlanması noktasında bir kamu görevlisi gibi görev yapan korucuların 2005 yılı ve sonrasında devam eden süreçte sosyal güvenlik haklarında çeşitli düzenlemeler yapılmış ve bugün gelinen noktada 5510 sayılı Kanunun 4 üncü maddenin birinci fıkrasının (a) bendi kapsamında sigortalı sayılmaktadırlar.Çalışmada korucuların sosyal güvenlik hakları konusunda ne gibi düzenlemeler yapıldığı ve haklarının neler olduğu literatür taraması yapılarak açıklanmıştır. Yaptıkları görev itibariyle kamu hizmeti yerine getiren korucuların 5510 sayılı Kanunun 4 üncü maddenin birinci fıkrasının (c) bendi kapsamında sigortalı sayılmalarının daha uygun olacağı değerlendirilmektedir. |

The protectors, who are in the board sense of public service due to the public service they perform, work together with the security forces against the terrorist organization in order to maintain the state authority in rural areas and ensure the safety of citizens and property within the scope of the powers and duties given by the Köy Kanunu no.442. for along time, the protectors had fulfilled the difficult and many social risks without any social security. The protectors who acted as a public servant in order to ensure public order have been regulated in terms of social security right in the period following 2005 and are considered as insured under the paragraph (a) of the first paragraph of Article 4 of the Law no.5510.In the study, what kind of regulations were made during the social security rights of the protectors and their rights were explained by literature review. It is considered that it is more appropriate for the protectors who perform public service to be insured under the scope of the first paragraph (c) of Article 4 of the Law no.5510. |
