Diğer mezheplerde olduğu gibi Maliki mezhebinde de İmam Mâlik'in vefatından sonra yeni meseleler ortaya çıkmış ve mezhebin temel kriterlerine göre bu meselelerin hükümlerini tespit etme ihtiyacı doğmuştur. Bu durum Maliki mezhebinin takipçilerini mezhebin temel metinlerini incelemeye sevk etmiştir. Tıpkı bir mezhebin oluşumunda Kur'ân ve Sünnet'in incelendiği gibi. Dört mezhep imamlarından sonra yapılan bu incelemeler neticesinde her mezhebin fetva verirken kullandığı ölçütler imkân nispetinde tespit edilmeye çalışılmıştır. Tespit edilen ölçütlere göre de karşılaşılan yeni meselelerin hükmü tayin edilmiş, bu işleme de tahric adı verilmiştir. Tahric asırlar boyunca mezheplerin takipçileri olan âlimler tarafından kullanılmış fonksiyonel bir faaliyettir. Diğer yandan bu faaliyet fıkhî içtihadın da bir dalı sayılmıştır. Özellikle Maliki mezhebinin tahric faaliyetine önem verdiği nevazil kitaplarından anlaşılmaktadır. Bu çalışma ilgili ehemmiyeti ortaya koymak amacıyla tahricin tanımlarını, tarihsel gelişimini, mezhepler ve tahric ilişkisini ve özellikle Malikî mezhebinde tahricin yerini kaleme alan bir çalışmadır. After the death of Imam Malik, new issues emerged in the Maliki sect, as in other sects, and there was a need to determine the provisions of these issues according to the basic criteria of the sect. This situation led the followers of the Maliki sect to examine the basic texts of the sect. Just as the Qur'an and Sunnah are examined in the formation of a sect. As a result of these examinations carried out after the imams of the four sects, the criteria used by each sect to give fatwa were tried to be determined as much as possible. According to the determined criteria, the provision of new issues was determined and this process was named as tahric. Takhrij is a functional activity used by scholars who are followers of sects for centuries. On the other hand, this activity is considered as a branch of jurisprudence. It is understood from the nawazil books that Maliki sect gives importance to tahric activity. This study is a study that reveals the definitions, historical development, the relationship between sects and takhrij, and especially the Malikî sect in order to reveal the importance.
