Bu araştırma Maliki usulü fıkhını, burada yaşanan ihtilafları ve bu ihtilafların bir neticesi olan birbirinden farklı fıkhî hükümleri ele almaktadır. Yapılan araştırma esnasında Malikilerde usul düşüncesi, usul düşüncesinin gelişim evreleri ve bu evrelerin Maliki usulünün oluşumuna etkileri üzerinde duruldu. Maliki ekollerinin kurulması, özellikleri ve en önemli temsilcilerinden bahsedildi. Malikilerin de görüşlerini dayandırdığı genel usul kuralları ile Malikilere has usul prensiplerinden bahsedildi. Malikilere has usul kaidelerindeki esnek yapının mezhebin gelişmesine etkileri ve ortaya çıkan yeni fıkhî sorunları çözmedeki kabiliyeti dile getirildi. Ayrıca Malikî fıkhının diğer özelliklerine de yer verildi. Bu arada İmam-ı Malik'in usul yöntemi hakkında da bilgi verildi. Araştırmada daha çok usulü fıkıh ihtilafının bir sonucu oluşan fıkhî uygulama farklılıklarına dair örnekler verildi. Bu örnekleri daha çok usulü fıkıh ihtilafının bir sonucu oluşturmaktadır. Örnekler verilirken ihtilaflı hangi usul kaidesinin bu farklı uygulamaya sebep olduğu, bu konudaki Malikî âlimlerinin görüşleri ve tercih edilen görüşün hangisi olduğu verilmeye çalışıldı. Çalışma yapılırken Malikî mezhebine ait görüşler üzerinde araştırma ve sentezleme yöntemi kullanıldı. Mezhebe ait görüşler analiz edildi ve tercih edilen anlayış ortaya konulmaya çalışıldı. Yapılan araştırma sonucunda fıkhî ihtilafların büyük bir çoğunluğunun usul ihtilaflarına bağlı olduğu görüldü. İmam-ı Malik'in usule dair bir metin ortaya koymadığı tespiti üzerinde duruldu. Araştırmayla Malikilerde fıkıh usulüne daha çok önem verilmesinin bir ihtiyaç olduğu ortaya çıktı. Çünkü Maliki fıkhında hala açıklığı kavuşturulamamış birçok fıkhî mesele bulunmaktadır. O nedenle fıkıhla irtibatlı olmak kaydıyla usul bilgisine önem verilmesi gerekmektedir. Fıkıh usulünün hedefinin fıkhî hükümlere nasıl ulaşılacağının yolunu göstermek olduğu unutulmamalıdır. This research dealt with the subject of the origins of Maliki's jurisprudence and the difference between it and what resulted from this difference in the branches of jurisprudence Through the study of Maliki's fundamentalist thought and the stages he went through with a statement of the nature of each stage and its role in the formation of the assets of the Maliki's Al-Malikya schools and the ways of establishing them and the features of each school and mentioning the most prominent men of these schools, and studying the general assets on which the Maliki's relied, as well as the private assets that the Maliki's were unique to others and how these assets were the reason for the flexibility of the doctrine and its validity to derive the provisions of all calamities, Which is known as the origins of Imam Malik This study deals with the practical aspect of the research, which is the mention of the jurisprudential applications that resulted from the difference in the fundamentalist rule, by mentioning the different fundamentalist rule and the statement of the Maliki's in it and the most likely of them. The branches that follow this rule This study was based on the analytical inductive method by following the words of the Maliki's in question and then analyzing these statements and a more correct statement And I have recommended to increase attention to the fundamentals of jurisprudence al-Maliki; because there are many issues did not detail the statement in which it must be separated, and also must pay attention to the study of assets linked, because the objective of studying the fundamentals of jurisprudence is to find out how to derive jurisprudential rulings.
