Türkiye'deki kamu kurum ve kuruluşları genellikle işçilik maliyetini düşürmek, personel ihtiyacını karşılamak, yönetimsel fonksiyonları daha etkili hale getirmek ve esneklik sağlamak amacıyla asıl işe yardımcı hizmetler olarak nitelendirilen temizlik, güvenlik, bilgi işlem ve yemek hizmetlerini özel sektörden hizmet alımı yoluyla yani taşeron firmalardan satın alarak yerine getirmeyi tercih etmektedir. Son yıllarda da bu uygulama tüm kamu kurumlarında giderek yaygınlaşmış ve ülkemiz gündemini uzun süre meşgul etmiştir. Yükseköğretim kurumlarında da hizmet alımı yoluyla personel çalıştırılması, işlerin bir bölümünün taşeron firmalara devredilmesi, kamu görevlisi istihdamı yapılabilecekken bu insan kaynağının taşeron firma üzerinden çalışan personelle giderilmesine neden olmuştur. Yükseköğretim kurumlarında kamu hizmetine yardımcı işlerin taşeron firmalar yoluyla yaptırılması idare hukuku açısından bakıldığında hizmet alımı 4734 sayılı Kamu İhale Kanunu (KİK) ve 4735 sayılı Kamu İhale Sözleşmeleri Kanunu (KİSK) hükümlerine göre yapılmıştır. 4734 sayılı KİK'in dördüncü maddesinde hizmet alımına konu edilebilecek işler belirtilmiştir. Ayrıca 4857 sayılı İş Kanunu çerçevesinde hangi hizmetlerin taşeron firmalara verilebileceği de belirtilmiştir. Çalışmada 1992 yılında kurulan devlet üniversitelerindeki taşeronlaşma değerlendirilmiştir. 02 Nisan 2018 tarihinde taşeronların sürekli işçi olarak kadroya geçirilmesi ile kamu kurum ve kuruluşlarında taşeron çalışma son bulmuştur. Çalışmada 1992 yılında kurulan devlet üniversitelerinde memur hizmet sınıflarının ikamesinde taşeronlaşma değerlendirilmiştir. Anahtar Kelimeler: Kamu Hizmeti, Taşeron, İstihdam, Hizmet Alımı. |

Public institutions and organizations in Turkey generally to reduce labor costs, staff to meet the needs, administrative functions to make it more effective and flexibility in order to ensure the actual work to help qualified as services cleaning, security, computing and buy from that subcontractors through private sector service purchase their meals service prefers to fulfill. In recent years, this practice has become increasingly widespread in all public institutions and has occupied the agenda of our country for a long time. Employing personnel in higher education institutions through service procurement, transferring some of the jobs to subcontractors, employing civil servants caused this human resource to be eliminated by subcontracting personnel. In terms of administrative law, the procurement of services in higher education institutions through subcontractors is performed in accordance with the provisions of the Public Procurement Law (4734) and the Public Procurement Contracts Law (4735). In the fourth article of the 4734, the works that can be subject to service procurement are stated. In addition, within the framework of Labor Law (4857) which services can be provided to subcontractors. In this study, subcontracting in state universities established in 1992 was evaluated. On April 2, 2018, subcontracting of the subcontractors as permanent workers resulted in subcontracting in public institutions and organizations. In this study, subcontracting was evaluated in substitution of civil servant service classes in state universities established in 1992.
