Çocuğa genel olarak hayatının her evresinde bir çocuk dense bile, yasal statüleri açısından ilgili hükümlerin sağlanması için farklı fıkhî durumlar bulunmaktadır. Özellikle "rüşd" ve "bulûğ" evrelerinin öz olarak benzerlikleri ve farklılıkları alimler tarafından farklı şekillerde yorumlanmıştır. İslâm Hukuku ise bu iki dönem ile ilgili pek çok ayrıntılı açıklamaya sahiptir. Kişinin din ve hukuk karşısındaki yetkinliğini ifade eden ehliyet kavramıyla doğrudan ilişkili olan bulûğ ve rüşd kavramlarının inceleme konusu edildiği bu çalışma iki bölümden oluşmaktadır. Çalışmamızın birinci bölümünde insan hayatının evreleri, ehliyet kavramı ve ehliyet arızaları gibi konular üzerinde durulmuş, İslâm Hukuk doktrininde ehliyet dini-hukukî açıdan incelenmiştir. Çalışmamızın ikinci bölümünde ise bulûğ-rüşd ilişkisinin fıkhî / hukukî sonuçları ele alınmıştır. İslâm hukuk doktrininde bulûğ ve rüşd yaşı konusundaki farklı değerlendirmelere de değinilmiştir. Çocuğun tasarrufları araştırılmış, hak ve sorumlulukları üzerinde değerlendirmeler yapılmıştır. Farklı İslâm düşünürlerinin görüşleri üzerinde durulmuştur. In general, even if the child is a child in every phase of his / her life, there are different Fıkhî cases to provide the relevant provisions in terms of their legal status. Particularly the similarities and differences of the Rushd and Bulûğ stages were interpreted in different ways by scholars. Islamic Law has many detailed explanations about these two periods. This study, in which the concepts of bulûğ and rushd, which are directly related to the concept of competence that expresses the competence of the person against religion and law, are examined and this study consists of two parts. In the first part of our study, the subjects such as the stages of human life, the concept of driving license and the problems of driving license were emphasized. In Islamic Law doctrine, the license was examined from a religious-legal point of view. In the second part of the study, the fiqh / legal results of the bulûğ- rushd relationship were discussed. In Islamic law doctrine, different evaluations of bullock and age of citizens are also mentioned. The savings of the child were investigated and their rights and responsibilities were evaluated. The views of different Islamic thinkers are emphasized. Keywords : Puberty, Maturity, Islamic Law, Capacity of Senses. |
