Anayasa Mahkemesine bireysel başvuru yolu 2010 yılında yapılan anayasa değişikliğiyle kabul edilmiştir. Bireysel başvuru yoluyla insan haklarının daha etkin bir şekilde korunması hedeflenmiştir. Bireysel başvuruya ilişkin anayasa hükümleri ve Anayasa Mahkemesinin vermiş olduğu bazı kararlar öğretide çeşitli tartışmalara yol açmıştır. Bu tartışmalardan biri de bireysel başvurunun konusu olan temel hak ve özgürlüklerin kapsamının belirlenmesine ilişkindir. Bireysel başvuruya konu olabilecek temel hak ve özgürlüklerin neler olduğu Anayasanın 148. maddesinde düzenlenmiştir. Anayasa Mahkemesi bireysel başvuruya konu olabilecek temel hak ve özgürlükler ile bunların kapsamını belirlerken “ortak koruma alanı” formülünü kullanmaktadır. Hem madde metni hem Anayasa Mahkemesinin bu metni yorumlaması üzerinde tartışmalar yapılmıştır. Anayasa Mahkemesinin içtihadı yerleşik hale gelse de konuya ilişkin tartışmalar sürmektedir. Bu makalenin konusunu bireysel başvuruya konu olabilecek temel hak ve özgürlüklerin kapsamının belirlenmesi oluşturmaktadır. Hangi temel hak ve özgürlüklerin bireysel başvuru konusu olabileceği hususu, çalışma konusuyla yakından ilişkili olmakla birlikte, makalenin odaklandığı temel konu, yapılan bir bireysel başvuruda esas yönünden inceleme yapılırken ihlal edildiği ileri sürülen temel hak ve özgürlüklerin kapsamının nasıl belirleneceği sorunsalıdır. Makalede öğretide ileri sürülen görüşler ve Anayasa Mahkemesinin yaklaşımı irdelenmiştir. Bireysel başvuruya konu hakların kapsamının belirlenmesinde Anayasa Mahkemesi, Anayasa ve Avrupa İnsan Hakları Sözleşmesi düzenlemelerinin kesişimini kullanmaktadır. Anayasa Mahkemesinin bu yaklaşımı, hak ve özgürlüklerin kapsamını daralttığı gerekçesiyle eleştirilmektedir. Öğretide çeşitli çözüm önerileri ortaya atılmıştır. Ancak Anayasa Mahkemesinin içtihadını değiştirmeden veya anayasa değişikliği yapılmadan, eleştirilerin sona ermeyeceği anlaşılmaktadır.Individual application to the Constitutional Court was adopted with the constitutional amendment in 2010. The individual application aims to protect human rights more effectively. The constitutional provisions on individual application and some decisions of the Constitutional Court have led to various debates in the doctrine. One of these debates is the determination of the scope of the fundamental rights and freedoms that are the subject of the individual application. The fundamental rights and freedoms that may be subject to individual application are regulated in Article 148 of the Constitution. The Constitutional Court uses the “common protection area” formula when determining the fundamental rights and freedoms that may be subject to individual application and their scope. There have been discussions on both the text of th e article and the Constitutional Court’s interpretation of this text. Although the ju risprudence of the Constitutional Court has become settled, the debates on the subject continue. The subject of this article is the determination of the scope of fundamental rights and freedoms that may be subject to individual application. Although the issue of which fundamental rights and freedoms may be the subject of an individual application is closely related to the subject matter of the study, the main focus of the article is on the problem of how to determine the scope of the fundamental rights and freedoms alleged to have been violated during the examination on the merits of an individual application. The article examines the views put forward in the doctrine and the approach of the Constitutional Court. In determining the scope of the rights subject to individual application, the Constitutional Court uses the intersection of the Constitution and the European Convention on Human Rights. This approach of the Constitutional Court is criticized on the grounds that it narrows the scope of rights and freedoms. Various solutions have been proposed in the doctrine. However, it is understood that the criticisms will not end until the Constitutional Court changes its jurisprudence or a constitutional amendment is made. Keywords
