Ceza Muhakemesi Kanunu yargılama makamı tarafından verilen kararların denetimini sağlayan birtakım yasal çareler düzenlemiştir. Bu yasal çarelere "Kanun Yolları" denilmektedir. Kanunda yargılama makamı kararlarının kesinleşmiş olup olmamasına göre kanun yolları olağan kanun yolları ve olağanüstü kanun yolları olmak üzere ikiye ayrılmaktadır. Temyiz de olağan kanun yollarından biridir. Bölge adliye mahkemelerinin faaliyete başlamasıyla beraber temyiz kanun yolunda mahkeme kararları hakkında sadece hukuka uygunluk denetimi yapılmaktadır. Temyiz kanun yolunda hüküm hakkında hukuka uygunluk denetimi yapılabilmesi için hükmün hangi hukuk kuralına aykırı olduğunun temyiz başvuru veya beyanında gösterilmesi gerekir. Ancak hukuka kesin aykırılık halleri istisnadır. Temyiz kanun yoluna başvururken belirtilmemiş dahi hükümde hukuka kesin aykırılık hali mevcutsa Yargıtay tarafından bozma kararı verilebilir. Ancak bunun için her bakımdan kabul edilebilir bir temyiz başvurusunun bulunması gerekir. Çalışmanın ilk bölümünde kanun yolları ile temyiz kanun yolu hakkında genel bilgilere yer verilmiştir. Kanun yolu ve temyiz kavramları açıklanmış, hangi kararların kanun yolu denetimine tabi olduğu ele alınmış, kanun yollarının türleri hakkında bilgi verilmiştir Çalışmanın ikinci bölümünde ise temyiz kanun yoluna başvurma hakkı bulunanlar, temyize tabi olan ilk derece mahkemesi kararları ile temyiz edilebilen ve edilemeyen bölge adliye mahkemesi kararları incelenmiştir. Bu bölümde ayrıca temyiz kanun yoluna başvuru koşulları ile temyiz kanun yoluna başvurmanın etkileri ele alınmıştır. Çalışmanın son bölümünde ise temyiz nedenleri incelenmiştir. Bu bölümde temyiz nedenleri hakkında genel bilgilere yer verilmiş; temyiz nedenlerinin ayrımı ele alınmış ve temyiz nedenleri Yargıtay kararları ve doktrindeki görüşler ışığında detaylı olarak incelenmiştir. The Criminal Procedure Code has regulated a number of legal remedies that ensure the control of the decisions made by the judiciary. These legal redress are called "Legal Remedies". Legal remedies are divided into two as ordinary legal remedies and extraordinary legal remedies, depending on whether the judgments of the judiciary are finalized in the law. Appeal is also one of the usual remedies. With the start of operation of the regional courts of appeal, only the legality control is carried out on the court decisions in the appeals legal way. In order to carry out an audit of compliance with the law, it is necessary to show in the appeal application or statement which legal rule the provision is against. However, certain violations of the law are exceptions. Even if the appeal is not stated when applying to the legal remedy, if there is a definite violation of the law in the provision, a decision of reversal may be given by the Supreme Court. However, this requires an appeal that is acceptable in all respects. In the first part of the study, general information about legal remedies and appeal law is given. The concepts of legal remedy and appeal are explained, which decisions are subject to legal control, and information is given about the types of legal remedies. In the second part of the study, those who have the right to appeal, the decisions of the first instance court, which are subject to appeal, and the decisions of the regional court of appeal, which can or cannot be appealed, are examined. In this section, the conditions for applying to the appeals legal remedy and the effects of applying to the appeals remedy are also discussed. In the last part of the study, the reasons for the appeal were examined. In this section, general information about the grounds of appeal is given, and then the classification of the grounds of appeal is examined.
