Navlun sözleşmesinde amaç eşyanın bir yerden başka bir yere deniz yoluyla taşınmasıdır. Navlun sözleşmesinin ifasının yolculuğa hazırlık, yükleme, yolculuk, boşaltma ve teslim olmak üzere beş aşaması vardır. Navlun sözleşmesinde en çok uyuşmazlık çıkan konulardan biri yükleme ve boşaltma aşamalarıdır. Bu aşamaların ne kadar sürede tamamlanacağı, ilgili faaliyetler sırasında sürenin nasıl işleyeceği, herhangi bir engelle karşılaşıldığında sürenin kesintiye uğrayıp uğramayacağı gibi hususlar uygulamada çeşitli uyuşmazlıklara sebep olmaktadır. Bu çalışmada ilk olarak navlun sözleşmesiyle ilgili genel bir inceleme yapıldıktan sonra yükleme aşaması incelenmiştir. Kanun'da yükleme ve boşaltma aşamasında süreler birbirlerine paralel incelendiği için starya ve sürastarya süresi bekleme süreleri olarak tek bir başlık altında yükleme ve boşaltma aşamasını kapsayacak şekilde incelenmiştir. Bu tez çalışmasında yükleme ve boşaltmada bekleme sürelerinin işlemesi, kesintiye uğraması ve hesabı Türk Hukuk sistemi ve çeşitli hukuk sistemleri ve dünyaca kabul edilmiş kuruluşlarca hazırlanan standart tip çarter sözleşmeleri karşılaştırmalı olarak incelenmiştir. Yüklemeyi takiben yolculuk aşaması ve daha sonra boşaltma aşaması ile ilgili bilgi verilmiştir. TTK'nda boşaltma aşaması yükleme aşamasına paralel hükümlerle düzenlendiğinden bu aşamada genel bir inceleme yapılmıştır. En son olarak navlun sözleşmesinin sona erme nedenleri incelenmiştir. The purpose of the freight contract is to transport the goods from one place to another via sea. The performance of the freight contract has five stages: preparation for the journey, loading, journey, discharging and delivery. One of the most controversial issues in the freight contract is the loading and discharging stages. Issues such as how long it will take to complete these stages, how the time will work during the relevant activities, whether the time will be interrupted when any obstacle is encountered, cause various disputes in practice. In this study, firstly, after a general examination of the freight contract, the loading phase was examined. Since the loading and discharging phases are examined in parallel with each other in the Law, laytime and demurrage times are examined under a single heading as waiting times, covering the loading and discharging phases. In this thesis, the processing, interruption and calculation of waiting times in loading and discharging are comparatively examined in the Turkish legal system, different law systems and standard type charter contracts prepared by world-renowned institutions. Following the loading, information is given about the journey phase and then the discharging phase. Since the discharging phase in Turkish Commercial Code is regulated with provisions parallel to the loading phase, a general examination was made at this stage.
