Bu çalışma giriş ve üç bölümden oluşmaktadır. Çalışmanın girişinde kelam ve fıkhın tanımlarında geçen ortak unsurlar açıklanmış ve din bilimleri içinde kelam ve fıkıh usûlünün yeri ele alınmıştır. Çalışmanın birinci bölümü İslam hukuk teorisinin kelamî temellerine ilişkindir. Burada özellikle hüküm problemi üzerinde durulmuş ve hükümle ilişkili olmak üzere hâkim bahsi incelenmiştir. Öncelikle genel hukuk teorileri bakımından hukukun kaynağı, akabinde İslam hukuku açısından hukukun kaynağındaki irade değerlendirilmiştir. Bu bağlamda İslam hukukunun kaynağında ilahî irade mi beşerî irade mi bulunduğu yoksa hukukun, akılla olgunun kavranmasından mı ibaret olduğu açıklanmıştır. Hukukun kaynağı nedir sorusunun kelamî/felsefî bir problem olduğu husn-kubh meselesi üzerinden dile getirilmiştir. İkinci bölümde fıkıh usûlünün kaynakları olarak kabul edilen Kitab ve sünnete yer verilmiştir. Bu doğrultuda Kitab ve sünnetin tanımına kelamın etkisi, Kitab ve sünnetin kaynaklık niteliği ve dinde otorite oluşları incelenmiştir. Kitab'ın tanımını yapan kelam yine aynı konuyla ilişkili olmak üzere Allah'ın kelamının kadîm mi hâdis mi olduğu problemini değerlendirmiştir. Söz konusu problem kelamda ele alındığı şekliyle ilişkili olarak fıkıh usûlünde de kullanılmıştır. Buna göre birinci bölümde geçtiği üzere, Allah'ın hitabının kadîm mi hâdis mi olduğu problemi emir, umum ve nesih gibi konular bağlamında bu bölümde incelenmiştir. Çalışmanın üçüncü bölümünde fıkıh usûlünün yöntemlerini belirlerken kelamdan ne ölçüde yararlandığı ele alınmıştır. Bu bölümde fıkıh usûlünün icma, kıyas, istihsan, maslahat gibi yöntemlerinin belirlenmesinde kelamın etkisi üzerinde durulmuştur. Kitab ve sünnetten şer'î delillerin çıkarılması işlevini gören ya da söz konusu şer'î delillerin kesinlik düzeyini belirlemede kendilerine başvurulan icma, kıyas, istihsan gibi fıkıh usûlü tarafından kullanılan yöntemler hem şer'î delil olarak isimlendirilmekte hem de yöntem niteliğinde kabul edilmektedir. This study consists of an introduction and three parts. At the beginning of the study, the common elements in the definitions of kalam and fiqh are explained and the place of kalam and fiqh method in religious sciences is discussed. The first part of the study is about the theological foundations of Islamic legal theory. Here, especially the problem of judgment has been emphasized and the issue of judge has been examined in relation to the judgment. Here, first, the source of law in terms of general legal theories, and then the will at the source of law in terms of Islamic law has been evaluated. In this context, it is explained whether there is divine will or human will at the source of Islamic law or whether the law consists of understanding the fact with the mind. It has been expressed through the husn-kubh/good-evil issue that the question of what the source of law is a theological/philosophical problem. In the second part, the Qur'an, and the Sunnah, which are accepted as the sources of the fiqh method, are included. In this direction, the effect of kalam on the definition of the Qur'an and Sunnah, the source quality of the Qur'an and the Sunnah and their authority in religion are discussed. Kalam, which defines the Qur'an, has dealt with the problem of whether God's word is not created or created, again related to the same subject. This subject, in relation to the way it is handled in kalam, has also been used in fiqh. Accordingly, as it is mentioned in the first chapter, the problem of whether Allah's speech is not created or created is examined in this chapter in the context of issues such as command, general and abrogation. In the third part of the study, the extent to which kalam is used while determining the methods of fiqh method is discussed. In this section, the effect of kalam in determining the methods of fiqh such as ijma, qiyas, istihsan and maslahat is emphasized. The methods used by the fiqh method such as ijma, qiyas and istihsan, which function to extract the shar'i evidence from the Qur'an and sunnah, or which are applied to determine the level of certainty of the shar'i proofs in question, are both named as shar'i evidence and accepted as a method.
