Soruşturma evresi suç şüphesinin öğrenilmesiyle başlar. Cumhuriyet savcısı soruşturma evresinin amiridir. Soruşturma evresinde savcı bizzat veya adli kolluk aracılığıyla soruşturmayı bir an önce sonuçlandırmak amacıyla araştırma yapar. Soruşturma evresi sonunda toplanan deliller, suçun işlendiği hususunda yeterli şüphe oluşturursa Cumhuriyet savcısı iddianame düzenleyerek kamu davası açar. Buna karşın yeterli şüphe oluşturacak delil elde edilememesi ya da kovuşturma imkânının bulunmaması halinde ise kovuşturmaya yer olmadığı kararı verir. Bu mecburilik ilkesinin bir sonucudur. Kanun koyucu bazı hallerde ise Cumhuriyet savcısına kamu davası açmada takdir yetkisi tanımıştır. CMK m. 171'de cezayı kaldıran şahsi sebep olarak etkin pişmanlık hükümlerinin uygulanmasını gerektiren koşulların ya da şahsi cezasızlık sebebinin varlığı halinde, Cumhuriyet savcısının kovuşturmaya yer olmadığı kararı verebileceği düzenlenmiştir. Yine aynı maddenin ikinci fıkrasında düzenlenen kamu davasının açılmasının ertelenmesi kararının şartları oluşsa da bu kararı verme yetkisi Cumhuriyet savcısının takdirine bırakılmıştır. Bu düzenleme ile maslahata uygunluk ilkesi uyarınca Cumhuriyet savcısına geniş bir takdir yetkisi tanınmıştır. Cumhuriyet savcısı, yürüttüğü soruşturma sonucunda kamu davasının açılması için yeterli şüphe oluşturacak delil elde edemediği veya kovuşturma olanağının bulunmadığı hallerde kovuşturmaya yer olmadığına dair karar vermek zorundadır. Adli ve idari niteliğe haiz bu karar kesin hüküm teşkil etmez. Bu karar idari olarak ilgili başsavcı tarafından; adli olarak ise bu kararı veren Cumhuriyet savcısının yargı çevresinde görev yaptığı ağır ceza mahkemesinin bulunduğu yerdeki sulh ceza hâkimliği tarafından itiraz üzerine denetlenmektedir. Ancak, CMK m. 173/5'teki açık düzenleme uyarınca Cumhuriyet savcısının CMK m. 171/1'de düzenlenen ve takdir yetkisine dayanarak verdiği kovuşturmaya yer olmadığı kararlarına karşı başvurulabilecek yargısal bir yol yoktur. Bu çalışmada, Cumhuriyet savcısı tarafından verilen kovuşturmaya yer olmadığı kararı ve kovuşturmaya yer olmadığı kararına karşı başvurulabilecek hukuki çareler incelenmiştir. The investigation phase begins with the informed of the suspicion of crime. The public prosecutor is the chief of the investigation phase. During the investigation phase, the prosecutor conducts the necessary surveys in person or through the judicial police in order to conclude the investigation as soon as possible. If the evidence collected at the end of the investigation phase creates sufficient suspicion that the crime has been committed, the Public Prosecutor prepares an indictment and opens a public lawsuit. On the other hand, if there is no evidence to create sufficient suspicion or if there is impossibility of prosecution, public prosecutor decides that there is no room for prosecution. This is a consequence of the principle of obligation to prosecute. In some cases, the legislator has granted discretionary power to the Public Prosecutor in filing a public lawsuit. In Code of Criminal Procedure (CCP) Article 171, it is regulated that the public prosecutor may decide not to prosecute in the presence of conditions requiring the application of effective repentance provisions or personal impunity as a personal reason for abolishing the sentence. Again, although the conditions for the decision to postpone the opening of the public lawsuit, which is regulated in the second paragraph of the same article, are met, the authority to make this decision is left to the discretion of the public prosecutor. With this regulation, a wide discretion has been given to the public prosecutor in accordance with the principle of compliance with the interests. The public prosecutor has to decision of non-prosecution in cases where, as a result of the investigation he/she conducts, he/she is unable to obtain sufficient evidence to sufficient suspicion or in cases where there is impossibility of prosecution. This decision, which has both judicial and administrative nature, does not constitute a final judgment. This decision is under of administratively supervision by the relevant Chief Public Prosecutor. Judicially, audited by magistrates' court in the place where the high criminal court where the public prosecutor works in the judiciary. However, according to the Code of Criminal Procedure 173/5, there is no judicial remedy that can be applied against the decisions of the non-prosecution of public prosecutor based on his discretion. In this study, the decision of non-prosecution of public prosecutor and legal remedies which can be applied against that decision.
