Türk hukukunda 4721 sayılı Türk Medeni Kanunu'na göre boşanma sadece yetkili mahkemeler aracılığı ile mümkündür. Boşanmanın gerçekleşmesi için TMK'da belirtilen sebeplerden birinin gerçekleşmiş olması gerekmektedir. Tezimizin konusunu oluşturan zina da TMK'da yer alan boşanma sebeplerinden biridir. Zina sebebiyle boşanma, TMK m. 161 hükmünde düzenlenmektedir. Hükmün lafzında zinanın tanımına yer verilmemiştir. Zina eyleminden ne anlaşılması gerektiği sorusunun cevabı da hükümden anlaşılmamaktadır. Bahsi geçen boşluklar neticesinde zina sebebiyle boşanma uygulamada ispat, kişilik hakkı ihlali, tazminatın belirlenmesi, üçüncü kişinin cinsiyeti gibi konularda sorunlar teşkil etmektedir. Bu husus özel olarak ele alınması gereken bir konu iken yeterli yoğunlukta çalışma yapılamamış ve incelenmemiştir. Ülkemizde genellikle aile hukuku kitaplarının bir kısmında kısaca yer almaktadır. Mevcut çalışmalarda ise genellikle tazminat uygulamaları kısmı boşanmanın mali sonuçları altında kısaca yer almaktadır. Açıklanan sebeplerle çalışmada zina kavramı, boşanma sebebi olarak zinadan bahsettikten sonra zina sebebiyle boşanma davası özelliklerine geçilmiş, zina sebebiyle boşanmanın hukuki ve mali sonuçlarına ve zinanın özel bir yansıması olan katılma alacağına etkisine yer verilmiştir. Ayrıca uygulamada maddi ve manevi tazminat belirlenmesinde sorun olan kıstaslar, üçüncü kişinin tazminat sorumluluğu ve hukukumuz bakımından yeni sayılabilecek arabuluculuğa uygunluk konuları ele alınmıştır. According to the Turkish Civil Code No. 4721 in Turkish proceedings, divorce is only possible with the conclusion of the competent courts. In order for the divorce to take place, one of the reasons stated in the TMK must have occurred. The content of our thesis, adultery is one of the reasons for divorce in the TMK. The answer to the question of what should be understood from the act of adultery is also not understood from the provision. As a result of the aforementioned gaps, divorce due to adultery poses problems in practice such as proof, violation of personal rights, determination of compensation, and the gender of the third person. While this issue is a subject that needs to be dealt with specifically, it has not been studied and studied with sufficient intensity. In our country, it is usually briefly included in some of the family law books. In current studies, the compensation applications part is briefly included under the financial consequences of divorce. For the reasons explained, in the study, the concept of adultery, after mentioning adultery as a reason for divorce, the characteristics of divorce case due to adultery were passed, the legal and financial consequences of divorce due to adultery and its effect on the participation claim, which is a special reflection of adultery, are included. In addition, the criteria that are problematic in the determination of pecuniary and non-pecuniary compensation in practice, the liability of third parties for compensation and compliance with mediation, which can be considered new in terms of our law, are discussed.
