İnsanlar toplumsal hayatın gerekliliği olarak birbirleriyle irtibatlı olmak zorundadır. Bu bağlamda insanın diğer insanlarla ilişkilerinde toplumun huzurunun bozulmaması için belli bir düzene ihtiyaç vardır. Bu ihtiyaca binaen hukuk kuralları oluşturulur. Müslümanlar birbirleriyle ilişkilerinde bazı kurallara riayet etmelidir. Bu kuralların ilmi de İslam hukukudur. Nitekim İslam hukuku insani ilişkileri düzenleyen ilkelere sahiptir. Özellikle İslam kamu hukuku ilmi, bireyin toplumsal yönü ve devlet hüviyetiyle kişilerin nasıl davranması gerektiğine dair temel ilkeleri ve kuralları haizdir. İslam'da kamu hukuku klasik dönemlerde ayrıca bir başlık altında incelenmemiş olsada kamu hukukunun ilkeleri hep var olagelmiştir. Çalışmadaki başlıklar, son dönem İslam kamu hukuku literatürlerinden esinlenerek yapılmıştır. Kamu hukukuyla ilgili ayetler, tefsire ve fıkha ilişkin özgün yaklaşımları olan ve Şâtıbî'den sonra makâsıd konusunu ele alarak müstakil çalışma ile yeniden gündeme taşıyan Tahir b. Âşûr özelinde yapılmıştır. Onun "et-Tahrîr ve't-Tenvîr" isimli tefsiri merkeze alınmıştır. Ayrıca Tahir b. Âşûr'un ayetlere yaklaşımı Hanefî ve Mâlikilerin genel görüşleriyle mukayese edilerek ortaya koymaya çalışılmıştır. Bu çerçevede Tahir b. Âşûr'un hangi görüşlerle mezheplerden ayrıldığını veya hangi görüşleriyle mezheplerle ittifak içerisinde olduğu durumları ortaya koyarak mukayeseli bir inceleme gayreti gösterilmiştir. Tahir b. Âşûr'un görüşlerini kendi coğrafyasında yaygın olan Mâlikî görüş ile Müslümanların ekseriyetle benimsedikleri Hanefî görüşle mukayese ederek ahkam ayetlerine dair hukuki çıkarımlarındaki özgün yönü daha net şekilde ortaya koymak hedeflenmiştir. Çalışmamız üç bölümden oluşmaktadır. Birinci bölümde çalışmamızın ana kaynağını oluşturan et-Tahrir ve't-Tenvîr isimli eserin yazarı olmasından dolayı ve çalışmamızın öneminin anlaşılması açısından Tahir b. Âşûr ve ilmi kişiliğinden bahsedilmiştir. Ayrıca konu kapsamı kamu hukuku olduğu için kamu hukukuna dair gerekli olan temel bilgilendirmeler yapılmıştır. Çalışmamızın ikinci bölümü kamu hukukunun alt başlığı olan Anayasa Hukuku, yasamamın yetkileri ve ilkeleri ayrıca temel hak ve hürriyetler çerçevesinde incelenmiştir. Üçüncü bölümde konu ile ilgili ayetler Devletler Genel Hukuku ve Mâli Hukuk başlığı altında uluslararası ilişkiler çerçevesinde değerlendirilmiştir. Mali hukuk kısmı ise Müslümanlardan ve gayri müslimlerden alınan vergiler başlığında incelenmiştir. Çalışmamız kapsamında Ceza hukuku başlığına neden yer vermediğimiz "Araştırmanın Konusu" başlığı altında izah edilmiştir. Araştırma neticesinde Tahir b. Âşûr'un içinde yaşadığı toplumda yaygın olan Mâliki mezhebinin görüşleriyle genellikle pararellik göstermesi özellikle yasama bölümünde ve İslam hukukunun temel ilkelerinden biri olan adalet anlayışında net olarak görülmektedir. Ayrıca kısas veya savaşla ilgili bazı durumlardaki görüşlerinin Hanefî ve Mâlikî mezhebinden tamamen ayrı olan gayeci yaklaşımları da tespit edilmiştir. People have to be in contact with each other as a necessity of social life. In this context, there is a need for a certain order in human relations with other people in order not to disturb the peace of society. Rules of law are established based on this need. Muslims must abide by certain rules in their relations with each other. The science of these rules is Islamic law. Indeed, Islamic law has principles that regulate human relations. In particular, the science of Islamic public law has the basic principles and rules on how individuals should behave with the social aspect of the individual and the state identity. Although public law in Islam was not analyzed under a separate heading in classical periods, the principles of public law have always existed. The headings in this study are inspired by recent Islamic public law literatures. The verses related to public law have been made in the special case of Tahir b. al-Ashūr, who has original approaches to tafsīr and fiqh and brought the issue of maqāṣid back to the agenda with an independent study after Shātibī. His tafsir "al-Tahrīr wa't-Tanwīr" is taken as the center. In addition, Tahir b. al-Ashūr's approach to the verses has been tried to be revealed by comparing with the general views of Hanafī and Mālikis. In this framework, an effort has been made to make a comparative analysis by revealing which views of Tahir b. al-Ashūr differ from the sects or which views of Tahir b. al-Ashūr are in alliance with the sects. By comparing Tahir b. al-Ashūr's views with the Mālikī view, which was widespread in his geography, and the Hanafī view, which was adopted by the majority of Muslims, it was aimed to reveal more clearly the original aspect of his legal inferences about the verses of ahkam. Our study consists of three parts. In the first part, Tahir b. al-Ashūr and his scholarly personality are mentioned because he is the author of al-Tahrir wa al-Tanwīr, which constitutes the main source of our study and in order to understand the importance of our study. In addition, since the scope of the subject is public law, the necessary basic information about public law has been given. The second part of our study is examined within the framework of Constitutional Law, which is a subheading of public law, the powers and principles of the legislature, and fundamental rights and freedoms. In the third part, the verses related to the subject were evaluated within the framework of international relations under the title of General Law of States and Financial Law. The financial law part is analyzed under the title of taxes levied on Muslims and non-Muslims. The reason why we did not include the title of Criminal Law within the scope of our study is explained under the title of "Subject of the Research". As a result of the research, Tahir b. al-Ashūr's parallels with the views of the Māliki sect, which was widespread in the society in which he lived, are clearly seen especially in the legislative section and in his understanding of justice, which is one of the basic principles of Islamic law. In addition, his views on some situations related to retaliation or warfare have been identified as purposive approaches that are completely different from the Hanafi and Mālikī madhhabs.
