Bu çalışmada Fıkhın İmar Uygulamalarına Etkisi üzerinde durulmuştur. Konuya ilgili kavram ele alınarak başlanmış daha sonra da bu alanla ilgili kaynaklar ve geçmişten bu güne bunun literatürdeki yerine değinilerek devam edilmiştir. Bu alanın en temel unsurlarından biri olan bina, birçok yönüyle değerlendirilmiş ve bunların yapısal olarak fiziksel ve kültürel faktörlerden etkilendiği ifade edilmiştir. Aynı zamanda binaların, bir kısmı yapım öncesini diğer bir kısmı da inşa sürecini ilgilendiren birtakım ilke ve esaslar çerçevesinde yapılmasının öngörüldüğü ifade edilmiş ve bunların her biri de fakihlerin görüşleri etrafında ortaya koyulmuştur. Fıkhın Müslümanlar tarafından meydana getirilen mimari yapılaşmadaki etkisi incelenmiş ve bu hususta belirleyici bir rol ve etkiye sahip olduğu belirtilmiştir. Bu anlamda cadde ve yollar ele alınmış ve bunların gerek genişlik gerekse kullanımı konusunda fakihlerce ortaya koyulan hüküm ve esaslar ifade edilmiştir. İlgili konuda üzerinde durulan bir diğer husus da konut ve diğer yapılar olmuştur. Bunlarla ilgili hususlarda fakihlerce belirlenen ve esas kabul edilen bazı prensiplerin belirleyici olduğu görülmüştür. Bunlardan biri olan ve temelinde de hadis bulunan zarar prensibine ilgili konuda oldukça geniş yer verildiği görülmüş ve fakihlerin ilgili husustaki birçok meseleyi bu prensip çerçevesinde değerlendirerek çözümlediği ifade edilmiştir. Ayrıca mezheplerin söz konusu prensiple ilgili yaklaşımları ele alınmış ve bu konuda özellikle Hanefî ve Mâlikîlerin söz konusu prensibi daha işlevsel kullanmaları yönüyle öne çıktıkları vurgulanmıştır. Farklı türdeki yapıların yol açtığı görmeye, sese, kokuya, duman ve sarsıntıya dayalı zararların önlenmesi konusunda fakihlerce etkin bir şekilde kullanılan söz konusu prensibin, İslam mimarisinde yapılaşmanın şekillenmesine yön veren en önemli etken olduğu belirtilmiştir. Konut ve diğer yapıların mimarisini etkileyen bir diğer prensibin de mahremiyet olduğu ifade edilmiştir. İslâmî açıdan oldukça önemli olan söz konusu prensibin özellikle konutların iç ve dış mimarisini etkilediği ve bu anlamda İslam mimarisine özel bazı unsurların yapılarda yer almasını sağladığı belirtilmiştir. Yine kıbleye doğru tuvalet ihtiyacını gidermenin fıkhî boyutu ve bunun yapılaşmaya etkisi, bu konuda varid olan hadisler ve bunlar üzerine yapılan yorumlar çerçevesinde değerlendirilmiştir. Geçmişte birbirine yakın şekilde oluşan yapılaşma sonucu ortaya çıkan irtifak hakları ile genel olarak ortak kullanımı söz konusu olan duvar ve tavanla ilgili mesele ve bunların hükümlerine de konumuzu ilgilendiren kısmıyla yer verilmiştir. In this study, the Effect of Fiqh on Zoning Practices is emphasized. The subject was started by dealing with the related concept and then continued by referring to the sources related to this field and its place in the literature from the past to the present. The subject was started by focusing on the concepts concerning the Islamic Reconstruction and Settlement Law and then continued by considering the sources of the Zoning and Settlement Law. The buildings, which are one of the most basic elements of an area, have been evaluated in many aspects and it has been stated that they are structurally affected by physical and cultural factors. Contemporarly, the buildings are envisaged to be built within the framework of some principles. Some of these are regarding with the pre-construction and the other part of the construction process and each of these has been put forward around the opinions of the jurists. The effect of Islamic construction and settlement law on the architectural structuring created by Muslims examined. It turned out that it has a decisive role and effect in this regard. In this sense, avenues and roads were discussed and the rules and principles alleged by the jurists regarding both their width and use were expressed. Another issue that was emphasized in the relevant subject was housing and other structures. It has been seen that some principles determined and accepted as the basis by the jurists are decisive in matters related to these. For instance, the principle of harm, which is based on hadith, has been given wide coverage in the relevant subject. It has been stated that jurists have evaluated and resolved many issues on the compatible issue within the framework of this principle. In addition to these, the approaches of the sects to the principle in question were discussed and it was emphasized that Hanafi and Malikis stood out in question more functionally in terms of using the principle. Having to do whit, this principle is used effectively by jurists to prevent the damage caused by different types of structures based on sight, sound, smell, smoke, and vibration. Indeed, these are the most important factors that shape the construction in Islamic architecture. Moreover, another principle affecting the architecture of residences and other buildings is privacy. It has been stated that this principle, which is very important in terms of Islam, especially affects the interior and exterior architecture of houses. In this direction, some elements specific to Islamic architecture are included in the buildings. In other words the fiqh dimension of eliminating the need for a toilet in the direction of the qibla and its effect on the construction are evaluated within the framework of the hadiths on this subject and the comments made on them. In the past, easement rights emerged as a result of the constructions that were close to each other. The issues and provisions related to the wall and ceiling, which are generally in common use, are included in the part that concerns our subject.
