Türk Ceza Kanunu’nda (TCK) adil yargılanma hakkının unsurlarından birisi olan bağımsız ve tarafsız mahkeme ilkesini korumaya yönelik yer alan suç türlerinden birisi adil yargılamayı etkilemeye teşebbüs suçu (TCK m. 288); diğeri ise yargı görevi yapanı, bilirkişiyi, tanığı etkilemeye teşebbüs suçudur (TCK m. 277). Adil yargılamayı etkilemeye teşebbüs suçu 765 sayılı (Mülga) Türk Ceza Kanunu’nda yer almayan, ilk olarak 5237 sayılı TCK’da düzenlenmiş bir suç tipidir. Hem yeni bir suç tipi olması nedeniyle uygulamada karşılaşılan sorunlar neticesinde madde kısa bir zaman diliminde önemli değişikliklere uğramış hem de TCK m. 277 ile olan benzerliği ve ilişkisi beraberinde tartışmaları da gündeme getirmiştir. Çalışmada her iki suç tipinin suç teorisi açısından özellikleri ortaya konmuş, maddelerin geçirmiş oldukları değişiklikler ile suçların birbirlerine olan benzerlikleri ve farklılıkları açısından geçirdikleri dönüşümler ele alınmış, korunan hukuki değer bağlamında her iki suç karşılaştırılarak nasıl bir düzenleme öngörülebileceği yönünde bir bakış açısı sunulmaya çalışılmıştır.
One of the types of crimes in the Turkish Penal Code (TPC) aimed at protecting the principle of an independent and impartial court, which is one of the elements of the right to a fair trial, is the crime of attempting to influence a fair trial (TPC art. 288) and the other is the crime of attempting to influence a judicial officer, expert, or witness (TPC art. 277). The crime of attempting to influence a fair trial is a type of crime that is not included in the (Repealed) Turkish Penal Code No. 765, but was first regulated in the Turkish Penal Code No. 5237. As a result of the problems encountered in practice due to it being a new type of crime, the article has undergone significant changes in a short period of time, and its similarity and relationship with TPC art. 277 has brought up discussions. The study revealed the characteristics of both crime types in terms of crime theory, discussed the changes that the substances have undergone and the transformations that crimes have undergone in terms of their similarities and differences with each other, and tried to present a perspective on what kind of regulation can be envisaged by comparing both crimes in the context of the protected legal value.
