et-Tahâvî ve el-Kerhî, asıllarla istidlâl adıverilen ve ilk defa el-Cessâs’ın teorik olarak tartışma konusu ettiği birictihâd yöntemi kullanmaktadırlar. Bu ictihâd yöntemi, sonraki dönemde doğrudantartışma konusu edilmese de, ona klasik hanefî teoride itibar edildiğianlaşılmaktadır. el-Cessâs’ın asıllarla istidlâle verdiği örneklerden birkısmı, klasik hanefî teoride lafızların delâletleri kapsamında değerlendirilmekte,diğer kısmı ise selefin itibar ettiği belirtilen bir istidlâl yöntemine denkdüşmektedir. İlk dönemde birbiriyle çelişen rivayetlerden birinin tercihibağlamında kullanılan asılların tanıklığı ifadesi de asıllarla istidlâlkavramıyla örtüşmektedir. |

Al-Tahawi and Al-Karhi usea method of ijtihad which it’s theory was established by Al-Cassas and called al-istidlalbi al-usul. Although this method of ijtihad is not discussed directly inthe next period, it is understood that it is respected in classical hanafitheory. Some of the examples given by Al-Cassas are considered within theliteral interpretation in the classical hanafi theory and the other examplescorresponds to a method of ijtihad which has been stated that the formerscholars have respected. The expression al-istishad bi al-usul which hadbeen used in the context of the preference problem in the early periods also correspondsto the concept of al-istidlal bi al-usul. |
